Please note that by using the Services, you agree to be bound by these Terms and Conditions. If you continue to use the Website or if you order products, we will take this as your acceptance of these Terms and Conditions.

We have used headings to help you understand these Terms and Conditions and to easily locate information. These Terms and Conditions are only available in the English language. We will not file copies of the contracts between us and you relating to our supply of the Services, so we recommend that you print or save a copy of these Terms and Conditions for your records (but please note that we may amend these Terms and Conditions from time to time so please check the Website regularly, and each time you use the Services to order products, to ensure you understand the legal terms which apply at that time).

 Registration

To use our services or features made available to you on this Site you will need to register. When you register     you are required to provide information about yourself that is true, accurate, current, and complete in all respects.  Should any of your registration information change, please notify us immediately at the following e-mail address Customercare@malatstore.com.  We may also change registration requirements from time to time.

The account password you provide should be unique and kept secure, and you must notify MALAT Store immediately of any breach of security or unauthorized use of your account.

 

Eligibility to Purchase

In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site is available only to individuals and others who meet the Malatstore.com terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to malatstore.com, whose applications are acceptable to malatstore.com and who have authorized malatstore.com to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase. Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, Malatstore reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

By making an offer to purchase merchandise you expressly authorize us to perform credit checks and where malatstore.com feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

Orders, Prices and Payment

  • Orders

All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.  To order products you must be over 18 years of age and possess a valid credit or debit card, please see payment section  below for details of acceptable payment methods. By placing an order, you are promising that all details you provide are true and accurate, that you are over 18 years of age, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds in the account to cover the cost of your order.

The Website allows you to check your order and correct any errors before completing a purchase. Please take the time to read and check your order at each page of the order process as you are responsible for ensuring that the information you provide is accurate (for example, the correct products, quantities, size, colour, etc.).

Your receipt of an electronic, or other form of, order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not your credit card has been charged. If applicable, your order will be refunded in the original form of payment. If your credit card has been charged and your order is canceled, we will immediately issue a refund to your credit card account in the amount of the charge and notify you that your order was canceled.  . Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.If your order is accepted, we will send you a confirmation email, which confirms that your order has been placed

Pre – Order / Customised Items

Please be aware that we may be unable to deliver selected Advance Payment items due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by email and refund the Advance Payment to your credit/debit card within thirty days of being advised that Product has become unavailable.

  • Prices

Prices shown on the Site are in USD , Euros  , Russian Rubls and Georgian Laris.

In case of shipping and delivery of products to any destination outside Georgia, local taxes and duties may apply in addition to the product price and possible shipping costs. Payment of such taxes and duties is Consumer’s sole responsibility and MALAT Store shall not be liable for any consequence of Consumer’s default thereof.

We are constantly updating and revising our offerings of Products, and we may discontinue Products at any time without notice. All pricing for the Products is subject to change. For all of our prices and Products, we reserve the right to make adjustments due to changing market conditions, Product discontinuation, manufacturer price changes, errors in advertisements, and other extenuating circumstances. If the price of an order changes after you’ve paid for it in full or after you’ve paid the down payment, your order will be canceled and your monies refunded.

We attempt to be as accurate as possible with Product descriptions and prices. However, we do not warrant that Product descriptions or prices are accurate. In the event that a Product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or Product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for Products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit or debit card has been charged. If your credit or debit card has already been charged for the purchase and your order is canceled, we shall immediately issue a refund to your credit or debit card account in the amount of the charge and advise you of the canceled order. If you are not completely satisfied with your purchase, you may return it in accordance with our Return Policy,

If you are a customer whose credit/debit card is not denominated in USD, Euros, Russian Rubls or Georgian Laris the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

  • Payment

We accept Visa and  Master Card any other methods which may be clearly advertised on the Site from time to time. You can also choose to pay with PayPal. When selecting this option at checkout, you will be directed to the PayPal site to ‘Log In’ and review the amount shown before clicking ‘Pay Now’. Once this transaction is complete, you will then return to www.malatstore.com Payment will be debited and cleared from your account upon dispatch of your order by MALAT Store. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to MALAT Store , we will not be liable for any delay or non-delivery.

MALAT Store  will not use your financial information (credit card number, expiry date, etc.) except for performing the procedure relevant to your purchase or issuing refunds in the case of returns in compliance with the exercise of your return right or for reporting cases of fraud to the police. The price for the purchase of products and the corresponding costs for shipping and delivery, as indicated in the order form, will be charged to your current account immediately upon confirmation of the order. We will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.

Gift Cards

MALAT Store Offers  Virtual Gift Cards , that are sold subject to the following terms and conditions:

  1. Gift Cards are valid for 12 months from date of purchase.
  2. Gift Cards can be redeemed against all products on the www.malatstore.com
  3. Gift Cards are non-transferable and may not be returned or redeemed for cash.
  4. If your order total is less than the value of the Gift Card, the remaining balance will be credited to your account and will be redeemed against subsequent orders. You may check your Gift Card balance online via your My Account page.
  5. If your order exceeds the value of the Gift Card and you have existing store credit on your account, this will automatically be redeemed to cover the remaining balance. All remaining balances exceeding the value of your gift credit or store credit must be paid by credit or debit card.
  6. If you return products you have purchased using a Gift Card, the remaining balance will be credited to your account as store credit and will be redeemed against subsequent orders. You may check your Store Credit balance online via your My Account page.
  7. Virtual Gift Cards will be e-mailed to the recipient once the full order has been processed and payment has been taken. A copy will also be sent to the sender as confirmation of dispatch.
  8. MALAT store is not liable for delivery of a Virtual Gift Card to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.
  9. MALAT store is not responsible if a Gift Card is lost, stolen, destroyed or used without permission.
  10. Sales tax and free shipping is applicable on any products purchased with a MALAT Store Gift Card.

Promo – Codes

Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided.

Promotions are only eligible for full-priced products and are limited to one per transaction, also minimum spends may be required. All promotions have an expiration date which will be indicated in your account or in any communication to the customer. Once a promotion has expired the amount may not be refunded. If the promotion is still active, it will be refunded back to the customer’s account to be used towards a future order.

Any and all MALAT Store contest rules and regulations will be communicated directly to the customer.

 

Shipping Policy

We offer two shipping options to meet your shipping needs: Free standard Shipping and Express shipping.Please check the shipping options at checkout for specific delivery options and fees.

Please note that the posted shipping time frame, if provided, may vary from item to item. The posted shipping time frame is contingent upon credit card approval and may be delayed should we experience difficulties in obtaining authorization.

All orders are dispatched with ‘No Signature Required’ and may be left at a residence deemed safe by the delivery company. MALAT Store  is not responsible for any loss or liability or damage that may result from leaving your package at the shipping address without a signature. If you prefer to have your order shipped with ‘Signature Required’ please contact customercare@malattore.com so that we may make arrangements.

MALAT Store is also not responsible for any international shipping delays caused by the customs clearance process.

 

Return and Exchange Policy

We are pleased to accept timely returns and exchanges of new and unused products within 14 days from the date you received your order. Returns can be refunded as Site Credit or to the original method of payment, where applicable. Please note that standard shipping is complimentary on all exchanges too.

Your products must be returned in the original packaging, including any boxes, hangers, garment bags, and other signature packaging materials, including MALAT and designer hanging tags. Other designer packaging such as belts, dust bags, authenticity cards, and leather tags should all be included where provide. If your order did not include the proper packaging please email Customercare@malatstore.com

Any returned products which are damaged, do not include the packaging materials, soiled, or altered may not be accepted and will be returned to you. Refunds or credits will not be processed until the items are returned and inspected by MALAT Store.

 

Reapeated Returns

We offer a flexible returns policy to make your online shopping experience even easier. We do monitor the number of returns made by customers, and continued returns will be flagged and potentially refused at our discretion or lead to the closure of your MALAT Store account

Customised Items & MALAT BOX

Please keep in mind that although customised items have an approximate 2 – 4 weeks lead time before they are ready to be shipped to you, payment will be taken shortly after you submit your order.

For any return or cancellation requests, MALAT reserves the right to offer a store credit. Store credit is valid for 6 months from the date of issue. This does not affect your statutory rights.

Late Returns

Any product returned outside of the 15-day return policy are at the discretion of MALAT Store, and may not be accepted or only accepted for Site Credit.

Shoes

Shoes must be tried on over a carpeted surface to prevent any scratches to the soles. All shoes must be returned in their original shoe box. Shoes returned without the original box, a damaged box, or marked soles may not be accepted and will be returned to you.

Faulty Products

Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty.

If your item is faulty when you receive it, you can return it for a refund. Simply request a return through your account and send the faulty goods back to us within 14 days of receiving your order.

If you discover a fault after this time, but within six months of purchase, you can still return it. Where possible, we will offer to repair the item. If it cannot be repaired and the same product is still available, we will send you a replacement. If the same product is no longer available, you are entitled to a full refund.

If you would like to exchange a faulty item instead of obtaining a refund, please be aware that we can only replace it for the same product in the same size, subject to availability.

Product Colors

We have made every effort possible to ensure the colors are displayed as accurately as possible. MALAT Store cannot guarantee your computer’s monitor will accurately display the true color. If you have any questions about the color of an item please contact

Final Sale

All products not eligible to be returned will be noted in the Product Details. No returns or exchanges will be accepted on the following items and sales of the following items are considered Final Sale:

Governing Law

These Terms and Conditions of Sale are governed by Georgian law.

 

 Amendments

The Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or any other reason MALAT Store finds appropriate and necessary. The new Terms and Conditions of Sale shall be effective as of the date of publication on www.malatstore.com. Please be sure to check the privacy policy each time you make a purchase, to be aware of your rights.
